TERMS AND CONDITIONS FOR REAL ESTATE PROPERTY PURCHASE IN THE TERRITORY OF MONTENEGRO BY FOREIGN BUYERS
Foreign natural and legal persons doing business in Montenegro can, on reciprocity basis, buy real estate property that is necessary for management of the concerned business in the territory of Montenegro.
Foreign natural persons who are not doing business in Montenegro can, on reciprocity basis (between Montenegro and the potential buyer’s country of origin), buy and own residential buildings, apartments and business premises in Montenegro.
Foreign legal and natural persons can establish enterprises in Montenegro. If the purchased real estate property is used for business activities, the enterprise in question can own the concerned real estate property under the same terms and conditions as a domestic enterprise.
Foreign natural persons and the Republic of Montenegro citizens enjoy the same rights, based on reciprocity, regarding inheritance of real estate property in the territory of Montenegro. Direct heirs (husband, wife and children) shall be exempted from inheritance tax payment.
Should you decide to buy real estate property in Montenegro, after the sales contract conclusion, you shall be obliged to pay an excise tax in the amount of 3% of the sales contract value, or 3% of the property value assessed by an authorized expert.
Once you have become a real estate property owner in Montenegro, you shall be obliged to pay an annual property tax which depends on the floor area size, age, location, the distance from the sea, infrastructure and equipment of the property.
When it comes to buying land in Montenegro, foreigner individuals can get titles on land unless it is classified as agricultural, or located in protected areas. Exceptionally, the foreign individual can buy the agricultural land, up to 5000 sqm in size, only if the scope (the subject) of the purchase agreement is the residential building that is positioned on the same land. Furthermore, if the land is urbanized (covered with DUP- Detail Planning), it can also be purchased without obstacles.
